Access to all Cherry Fund events will be controlled through the use of customized event wristbands. These wristbands may be picked up at the welcome desk and at the on-site box offices during designated time periods. Any lost, stolen, or damaged wristbands will not be replaced. Entry into all events is limited to persons who are at least twenty-one years of age on or before the day of the event. To gain entry to an event, a ticket or pass holder must check in at one of the site’s designated entry points with a valid wristband that permits access and a valid government-issued identification with a photograph.

All weapons, firearms, illegal substances, drug paraphernalia, fireworks, explosives, incendiaries, and outside food or drink is prohibited. All persons and property are subject to search upon entry and at any time on the event site. The event staff may confiscate any of the aforementioned prohibited items and any other items that might disrupt the event, jeopardize the safety and enjoyment of other ticket and pass holders, and/or disturb the peace. Ticket and pass holders may be removed from the premises and denied re-entry without any warning, prior notice, or compensation if they engage in prohibited conduct, disrupt the event, jeopardize the safety and enjoyment of other ticket and pass holders, and/or disturb the peace. Prohibited conduct shall include, but not be limited to, the following:

• Attempting to gain access to or being present in any restricted areas;
• Climbing any furniture, scaffolding, or other site infrastructure;
• Obstructing any entrances, exits, or evacuation routes;
• Wearing any clothing, disguise, or other face covering to avoid being recognized;
• Using, wearing, or displaying any language, symbols, gestures, or images that are obscene, racist, xenophobic, provocative, hate speech, or discriminatory;
• Using, possessing, distributing, or being under the influence of any illegal substances;
• Showing signs of alcohol intoxication causing one to be in an impaired state;
• Fighting, inciting violence, or disturbing the peace;
• No Lewd and lascivious behavior
• Using, possessing, distributing, and/or selling outside food or drink or any other products;
• Throwing, shooting, or discharging any object, liquid, gas, or aerosol; 
• Smoking in any non-designated areas;
• Vomiting, spitting, or urinating in public;
• Destroying or defacing any signs, decorations, or other site infrastructure;
• Littering or failing to maintain the cleanliness of the event site;
• Failing to declare or relinquish possession of any prohibited items;
• Refusing or resisting the directions of event staff and security personnel; and
• Attempting to re-enter after being removed or banned from the event.

All persons at the event acknowledge and agree to being photographed, recorded, and/or filmed. These images and recordings may be used, stored, reproduced, printed, published, streamed, broadcast, and/or sold by the Cherry Fund for archival, promotional, and/or commercial purposes, in any manner, and in any media, without permission or compensation. These images and recordings may also be used to identify and facilitate prosecution of any illegal or prohibited conduct. The purchase of any ticket or pass to, the use or possession of any wristband for, and/or any entry into or presence at a Cherry Fund event shall constitute acceptance of and agreement to be bound by the Event Terms and Conditions and the Privacy Policy posted on the Cherry Fund’s official website.

A ticket or pass is a revocable license to attend the event or events for which it was issued. Any violation or attempted violation of the Event Terms and Conditions, of any rules, policies, or regulations at the site, venue, or location, or of any local, state or federal laws, and/or any actions that may endanger, threaten, or harass event staff and/or other ticket or pass holders shall constitute grounds for revocation of said license, removal from the premises, and/or denial of re-entry without any warning, prior notice, or compensation. For safety reasons, the Cherry Fund reserves the right to postpone, cancel, interrupt, or stop an event; to provisionally keep visitors on-site at the end of an event; to totally or partially vacate an event site; and/or to deny access to an event – without any prior notice or compensation, regardless of the purchase of a ticket or pass and/or the possession of a valid wristband.

Any artists or performers and any sites, venues, or locations included in any promotional material is intended solely for informational purposes only, and does not, in any way, represent any importance or headline status. The Cherry Fund reserves the right to change, modify, or alter any aspect of any event (including, without limitation, the appearance of any artists or performers, the site, venue, or location, the order of events, and/or the schedule of any artists or performers), at any time, for any reason whatsoever, without any prior notice or compensation.

ALL EVENT TICKET AND PASS SALES ARE FINAL. EXCEPT AS OTHERWISE NOTED HEREIN, THERE WILL BE NO REFUNDS, EXCHANGES, OR RETURNS. TICKETS AND PASSES MAY NOT BE RESOLD, TRANSFERRED, OR ASSIGNED TO ANOTHER PERSON.

If an event is cancelled (in part or in whole) or postponed due to circumstances beyond anyone’s reasonable control, the Cherry Fund will offer an appropriate pro rata refund and/or reach reasonable accommodations with the affected ticket or pass holders. However, in all instances, the maximum remedy will be the face value of the ticket or pass – excluding all taxes, fees, and/or service charges paid in connection with the purchase.

The purchase of any ticket or pass to, the use or possession of any wristband for, and/or any entry into or presence at a Cherry Fund event shall constitute voluntary assumption of all risks and dangers, known and unknown, foreseeable and unforeseeable, resulting from and/or incidental to the event and whether occurring prior to, during, or after the event – including, but not limited to, any death, personal injury, loss, damage, or liability whatsoever. All persons entering or present at any event consent to any medical care and transportation in order to obtain treatment deemed necessary by event staff, security personnel, police officers, or medical professionals on site in the event of injury or illness at the event and agree to indemnify and hold harmless the Cherry Fund and all of the aforementioned persons for any acts or omissions related to any medical care and transportation.

The Cherry Fund accepts no liability for any consequential or incidental damages – including any wages, vacation time, business profits, transportation, dining, or lodging expenses lost in connection with travel to and/or attendance of an event. All ticket and pass holders are encouraged to independently purchase appropriate travel insurance. In no event shall the Cherry Fund be liable for any claim unless written notice is given within six months from the date of the injury or loss. No suit for any cause may be maintained against the Cherry Fund unless it is brought no more than one year after the event.

These terms and conditions shall be governed by and construed under the laws of the District of Columbia. Any controversy or claim arising out of or relating to these terms shall be brought only in the courts located in the District of Columbia, unless otherwise specified. All parties hereto specifically consent to personal jurisdiction of said courts. If any provision of these terms and conditions is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible so as to effect the intent of the parties hereto, and the other provisions contained herein will remain in full force and effect. Any failure of the Cherry Fund to insist upon or enforce any provision of these terms and conditions shall not be construed as a waiver of any provision or right.
